Fall Line Outdoors, a Chapter of the North Carolina Wildlife Federation
WAIVER, RELEASE, AND HOLD HARMLESS AGREEMENT
(hereinafter, the “Agreement”)
Fall Line Outdoors is a Chapter of the North Carolina Wildlife Federation, a nonprofit wildlife-conservation organization that provides public outdoor and educational opportunities. Activities are conducted pursuant to North Carolina Statute §38A – Landowner Liability, and Fall Line Outdoors, the North Carolina Wildlife Federation, and all participating landowners are entitled to all limited-liability protections provided under that statute and related provisions of Chapter D.
AGREEMENT, ACKNOWLEDGMENT, AND ELECTRONIC SIGNATURE
By submitting an event or volunteer application for Fall Line Outdoors, you are electronically signing this Agreement and certify that you have read, understand, and agree to all terms below. You acknowledge that your electronic signature has the same force and effect as a handwritten signature and you accept that your electronic signature is legally valid and enforceable under North Carolina law.
You must be 18 years of age or older to sign electronically.
If you are under 18, you must:
- Print and sign this Agreement
- Obtain a parent or legal guardian’s signature
- Email the signed copy to FallLineNCWF@gmail.com
- Bring the original signed document to event organizers
TERMS OF PARTICIPATION
- Participation in Fall Line Outdoors programs is voluntary and unpaid.
- Outdoor activities—including but not limited to hunting, fishing, hiking, boating, and skills instruction—carry inherent risks that may result in accidents, injuries, property damage, or death.
Risks include, but are not limited to: firearms, archery equipment, boats, water hazards, ATVs, uneven or unstable terrain, hidden ground openings, fallen trees, elevated tree stands, knives and cutting tools, weather exposure, insects, ticks, snakes, and other natural hazards.
- I confirm that I am physically and mentally fit to participate unless otherwise disclosed in my application or in writing to event organizers prior to participation.
- I voluntarily accept, without prejudice or exception, to assume full responsibility for my own safety, decisions, and actions, as well as the safety and actions of any individual I bring or for whom I am responsible for.
- I understand that I may leave any activity at any time if I have safety concerns.
- I understand that no insurance is provided by Fall Line Outdoors or any landowner and that I am solely responsible for all medical costs, property damage, or other expenses arising from my participation, for myself and any individual I bring or for whom I am responsible.
RELEASE OF LIABILITY
In consideration for being permitted to participate in Fall Line Outdoors activities, I, on behalf of myself and anyone for whom I bring or for whom I am responsible (including but not limited to my guests, spouse, heirs, executors, administrators, and assigns), hereby fully and permanently release and discharge:
- Fall Line Outdoors
- The North Carolina Wildlife Federation
- All landowners hosting activities
- All officers, staff, volunteers, mentors, agents, and representatives of the above entities
from any and all damages, liabilities, claims, demands, actions, losses, costs, or expenses (including medical expenses, property damage, court costs and attorney’s fees), whether known or unknown, arising out of or related to my participation and for participation by any individual I bring or am responsible for, in any Fall Line Outdoors program or event.
This release applies to the fullest extent permitted by North Carolina law.
INDEMNIFICATION
I agree to indemnify, defend, and hold harmless Fall Line Outdoors, the North Carolina Wildlife Federation, all participating landowners, and all officers, staff, volunteers, mentors, agents, and representatives of these parties from any and all damages, liabilities, claims, demands, actions, losses, costs, or expenses (including medical expenses, property damage, court costs, and attorney’s fees) arising from:
- My acts or omissions,
- The acts or omissions of any individual I bring or for whom I am responsible, and
- Any claim, demand, or action brought by another participant, landowner, or third party that results from my actions, conduct, or negligence, whether intentional, negligent, or accidental, while participating in or attending any Fall Line Outdoors activity.
This indemnification obligation applies to the fullest extent permitted by North Carolina law.
SEVERABILITY
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable under North Carolina law, that provision shall be modified only to the extent necessary to make it enforceable, and all remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any single provision shall not affect the validity or enforceability of the remainder of this Agreement.
GOVERNING LAW AND VENUE
This Agreement shall be governed by and interpreted in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute, claim, or legal action arising out of or relating to this Agreement or participation in Fall Line Outdoors activities shall be brought exclusively in a court of competent jurisdiction located within the State of North Carolina.

If you do not acknowledge this Agreement electronically, you must sign below and return the completed document before participating. Failure to do so may delay or prevent approval for participation.
